Medical Malpractice

Nurses Fail to Inform Surgeon of Pain and Numbness Following Laminectomy - When Epidural Hematoma is Diagnosed Hospital Fails to Provide Operating Room Emergently - Elderly Woman Rendered Paraplegic - $1.8 Million Verdict.


The plaintiff’s decedent, age eighty-seven at the time, was admitted to the defendant hospital for a laminectomy in January 2006. The surgery was successful, but the woman developed severe pain and other symptoms, including numbness and incontinence.

The nurses did not call the orthopedic surgeon.

During regular rounds the next morning the orthopedic surgeon found decedent with numb legs and in extreme pain. He ordered a stat CT scan which revealed an epidural hematoma which was compressing on the nerves. He asked for an operating room emergently, but the hospital did not provide one until mid-afternoon. A massive clot was removed during surgery.

The decedent became paraplegic due to the failures of the nurses and the hospital in providing the decedent with timely surgery. The woman died during the pendency of this matter.

The defendant claimed that any delay in the surgery made no difference in the outcome and that the decedent’s paraplegia could have been caused by her advanced age and progression of her spinal disease.

According to Litigation Reports a $1,818,583 verdict was returned.

Airplane Crash

The Boeing 737-300, operated by Merpati Nusantara Airlines, took off from Sorong-Dominique Edward Osok Airport, Indonesia, bound to Rendani, Indonesia. 97 passengers and six crew members were onboard. The plane overshot the runway when landing at Rendani, before coming to a stop in a river bed. All the 103 people onboard survived, but some 20 passengers reportedly sustained minor to serious injuries.

The weather conditions were bad at the moment of the accident, with lot of rain and poor visibility. Isolated thunderstorm accompanied by heavy rain, lightning and fog could have been a culprit in hampering the visibility of the pilot.

The plane touched down smoothly on its destination airport runway but it just didn't stop. It skidded off the runway, and came to a stop some 200 meters (650 ft) far from the runway threshold in a shallow river. The Merpati airline Boeing 737 broke in two pieces.

Rendani Airport has a single runway, 17/35, measuring 2.000 m x 30 m.

Presciption Drugs

It seems the society is driven by drugs. The Medical kind. There's a drug for everything, and evertime we don't feel well, we go to the doctor and get a prescription for more drugs.

Drugs are scientifically developed by the pharmaceutical conmpanies after many years of research, and then approved by the FDA. (Food and Drug Administration) Developing a new drugs can take 10 years of research and millions of dollars of investment that are lost if the drug is not approved by the FDA.

I trust the doctor. But can the doctor accidentally give me the wrong drugs? What happens if I get more sick? Can the pharmacy make a mistake and give me the wrong drugs? Airplane Crash kills 2

Airnorth - Embraer 120ER - Darwin, Australia - 22nd March, 2010

The Embraer 120ER belonging to Airnorth took off from Darwin Airport, Australia, for a training flight. The plane was intended to return a Darwin Airport after the flight. Two airmen were on the plane. The aircraft crashed seconds after take off at the airport's boundary, killing both crewmembers.


The crew of the turboprop plane was conducting a training flight. During take-off, they had performed a simulated engine-failure exercise manoeuvre, a manoeuvre considered as a routine training exercise. But seconds after take off, the aircraft veered off course, crashed in bushland and burst into flames.

Witnesses saw the plane banked sharply and plunged into the ground. Then a loud bang was heard, followed by several small explosions. A huge plume of smoke could be seen for several kilometres after the crash.

Man Gets Out of Bed Alone After Nurse Fails to Respond to Request for Assistance to Bathroom - Fall When Bed Moves as He Returns to Bed - Fractured Hip With Decline and Death - $125,000 Settlement.


The plaintiff’s decedent underwent heart valve repair surgery in February 2005. The decedent summoned a nurse to help him walk to the bathroom. The nurse did not come and the decedent went to the bathroom unassisted. On the trip back he placed his hand on the bad to get back into bed, but the bed moved and he fell.

The decedent suffered a fractured left hip which was repaired with surgery. The decedent deteriorated and he experienced delirium, loss of appetite, retention of fluids, bed sores and infection. The decedent died from respiratory failure secondary to pneumonia in March 2005 at the age of sixty-eight.

The plaintiff claimed that the decedent was not provided proper assistance to safely ambulate to and from the bathroom. The plaintiff also claimed that the hospital did not have adequate nursing staff, had failed to lock the brakes on the bed or inspect the bed to make sure the brakes operated properly, and had not properly monitored the decedent.

The defendant claimed that the decedent got out of bed despite instructions not to do so and was comparatively negligent in causing his own injuries.

A $125,000 settlement was reached.

Children's Eduacational Kits Recalled

About 2,300 units of a children's mathematical teaching aid called Carolina Function generator Kits imported (from Canada) by Carolina Biological Supply Co. of Burlington, N.C. has voluntary been recalled by the firm. The yellow lids contain excessive levels of lead that can be toxic to young children.

Baby Slings Product Recall

The San Diego Union Tribune reported yesterday that a San Diego maker of baby products has recalled more than 1 million baby slings. This was due to the request from Federal Regulators who linked the baby slings to three suffocating deaths.

The company Infantino based in Mira Mesa is replacing the "SlingRider" and WendyBellisimo" sling carriers with a different type of infant carrier.

The Consumer Product Safety Commission warned that people should cease using these slings with immediate effect. It is possible that a little baby could suffocate within minutes and not be able to cry out for help if the material blocks the mouth and nose of the baby.

Cell Phone Laws

Most states have had cell phone laws against using cell phones while driving a motor vehicle. But I still see many motorists talking away with their phone against their ear. Hello!! You need to have a hands free device like a blue tooth, a head set or installed into your vehicle radio-sound system.

Similar laws also apply to texting while driving.

It's illegal. It's unsafe. Stop doing it. Would you be happy if somebody else causes a serious injury accident with you while they were yapping on the cell phone? Well then you don't stop doing it to. When you enter your vehicle engage your hands free device. Do not answer the phone of your forgot to do that. Car Crash Death


El Cajon, Calif. - A 66-year-old patron at a El Cajon fast-food restaurant was killed today when a car crashed into it, but the 74-year-old driver was not seriously injured, an El Cajon police lieutenant said.

The crash happened just before 8:45 a.m. at the Carl's Junior outlet at 520 N. Second St., Lt. Jeff Davis said.

The victim, described as a regular customer, was sitting in a booth when a car driven by a 74-year-old El Cajon resident smashed into the restaurant, Davis said.

The man, whose name was not released, died at the scene, Davis said.

He said the driver, who witnesses said had just been at a nearby ATM, was hospitalized with injuries that were not life-threatening.

Alcohol or drugs did not appear to be a factor, he said.

Vehicle Accident


Man killed in Escondido accident is ID'd

ESCONDIDO Dec 24, 2009 — A man who was struck and killed by an out-of-control car as he was climbing into his pickup Wednesday has been identified as Arthur Tingleaf, 74, of Escondido, the Medical Examiner’s Office said Thursday.

Tingleaf was getting into his truck, which was parked at the curb in front of his home on Begonia Street, when he was struck by a Honda Accord that had crossed the lanes, authorities said.

Tingleaf died at a hospital a short time later.

Police interviewed the driver but did not make an arrest.

The crash is under investigation. Alcohol is not believed to be a factor.

Tingleaf lived in the home with his wife, the medical examiner said.
