Airplane Crash

All but two of the 40-plus passengers injured in the American Airlines 331 crash in Kingston, Jamaica, Tuesday have been released from area hospitals as investigators take a closer look at what may have caused the nonfatal "runway excursion."

The Boeing 737-800, filled to capacity with 148 passengers and a crew of six, came down in heavy rain and overshot the runway at Norman Manley International Airport. After its landing gear collapsed and the plane started to break up, it finally slid to a stop less than 10 feet from the Caribbean Sea, The Associated Press reported. (ABC News)

Jamaica information minister Daryl Vaz told the AP that 44 passengers were taken to area hospitals with injuries ranging from broken bones to back pain. Most of the injuries were cuts and bruises, and none were life threatening, American Airlines spokesman Tim Smith told the AP.

The plane began its journey at Reagan National Airport in Washington, D.C., before stopping at Miami International Airport then heading to Jamaica Tuesday night.

Medical Malpractice

When you are about to undergo a serious medical procedure or an operation, you want nothing but the best medical team at your bedside. You expect that your doctors and surgeons will, in fact, be nothing but the best. You expect them to provide you with the highest quality medical care. The reality of the medical situation in the United States is that many hospitals are understaffed. As a result, many medical staff members are overworked and their fatigue can result in negligence or treatment errors.

If you are injured by a doctor’s negligent performance, a personal injury lawyer can help you to evaluate whether you may have a case for medical malpractice. In order to recover damages, you must first prove the standard of care, a failure to meet that standard, and an injury. Those things can be quite complicated. A competent and caring personal injury lawyer can help you with your case.

Coast Guard vessel hits boat, killing boy

— An 8-year-old boy was killed and five people were injured when a Coast Guard vessel responding to an emergency call struck a pleasure boat during the San Diego Bay Parade of Lights Sunday night.

The 33-foot Coast Guard vessel hit the civilian boat, which had 13 people on board, about 6 p.m. near Harbor Island, said Jetta Disco, a Coast Guard spokeswoman.

“We heard them saying ‘Watch out’ and ‘Oh my God,’ ” said Breck Schoch, an eyewitness. “They had half a second warning before the thing hit.”

The boy killed in a boat crash was identified as Anthony Cole DeWeese of Rancho Peñasquitos, Anthony was taken to UCSD Medical Center, where he died about an hour after the accident. He had gone to the boat parade with his family, said his grandmother, Sandra DeWeese of Del Mar.

Feds Point to Stuck Gas Pedal in Lexus Crash

Federal investigators have found a stuck accelerator played a significant role in the crash of a Lexus that killed a CHP Officer and three family members on state Route 125. On Sept. 26, off-duty CHP officer Mark Saylor, 45, was driving a Lexus ES 350 on SR-125. Witnesses reported seeing a Lexus weaving through traffic at a high rate of speed. Saylor tried to make a left turn, but he was going too fast and struck a Ford Explorer. The Lexus broke through a fence and struck a dirt embankment, catapulting it through the air more than 100 feet. Saylor; his wife, Cleofe, 45; their daughter, Mahala, 13; and his brother-in-law Chris Lastrella, 38, died in the Aug. 28 crash.

The National Highway Traffic Safety Administration (NHTSA) said in a new report that during inspection, "removal of the mat was difficult because the bottom edge of the accelerator pedal had melted to the upper right corner of the mat. Further inspection of the mat revealed that while it was a Lexus brand mat, it was not the "correct application" for the vehicle, the report showed. The mat in the crashed Lexus was made for a Lexus RX400h, according to the report.

How to choose the right Doctor following and Accident

Another common mistake people make following an automobile accident is neglecting to obtain appropriate and timely medical attention.

This is crucial for properly creating a personal injury claim that will achieve maximum benefit.

Depending on the severity of the accident, victims often travel by ambulance to the emergency room.

In the case of soft tissue ("sprain/strain") claims there is little medical benefit which can be achieved by going to the emergency room for a "$100.00 aspirin").

One should note, however, that insurance companies do tend to evaluate claim value higher when there has been a trip to the emergency room, even in the lesser injuries.

In either case, again depending if the injuries are fractures, neurological injuries (i.e. disc compression) or soft tissue, it is important to receive timely follow up medical attention.

In the case of the soft tissue cases, this would usually constitute physical therapy of chiropractic care.

Often, injury victim without insurance assume that treatment is not available, since they assume they can not afford it.

I have had many a client come to me for representation a week or more following an accident who has failed to receive any treatment.

If the injury victim contacts a knowledgeable personal injury attorney, that attorney should be able to refer them to a doctor who will accept a medical lien. This means that the attorney agrees to pay the victims medical bills following the personal injury settlement with the insurance company.

The medical lien allows the injury victim to obtain treatment now and "pay later".

A reputable attorney will often work with orthopedics, neurologists, MRI centers, physical therapists and other health care providers on the lien basis to ensure treatment is effective, timely and well documented.

This ensures that the accident victim will have the best care an the best case possible. For more information regarding auto injuries call Allan Field

How insurance claims adjusters initiate the personal injury claim-the "recorded statement"

Many people come to my office for help after first trying to "settle their auto accident cases by themselves"

This can often be a fatal and irreversible mistake.

The things that are said and done by the accident victim in the first few days following the accident can often " set the tone" for the entire case.

One of the first tricks an adjuster for the at fault party will do, once initial contact is made with the victim, will be to secure a "recorded statement".

A crafty adjuster will contact the victim, either by phone or in person, to "chat" with them about their accident. Often, the adjuster will try to be conversational and act genuinely concerned about the physical and mental state of the victim..they will be your new best friend..or not.

The actual purpose in these initial conversations is to establish just how injured, or UNINJURED the victim is.

Often, in soft tissue ("sprain/strain") types of cases, the victim will not feel the effects of an injury for several days following the accident.

THAT IS WHY THE ADJUSTER WILL TRY TO SECURE A STATEMENT FROM THE VICTIM AS SOON AS POSSIBLE FOLLOWING AN ACCIDENT.

When the adjuster asks "how are you feeling today Ms. Jones?" they are hoping you will say "fine" or "not to bad". Once they have secured this information..it diminishes and latter claim from the victim that NOW (4-5 days latter) they are starting to hurt.

After all..if you were "really injured " in a traumatic event like a car accident..wouldn't you know it "right away" ? If not..are you really "all that injured"?

Recorded statements..the oldest trick in the book..and one a good attorney will always protect a client from falling in the adjuster's trap.

Here's what the auto accident victim should do at the scene, immediately following the incident:

What you do once the broken pieces have been swept up and the various parties leave the scene is equally critical.

Insurance companies seem to value a claim "higher" if there are ambulance and emergency room visits following an accident.

From a logical perspective, this does not make a lot of sense on "soft tissue" or "sprain/strain' types of injuries, because there is not much that these services can do for your overall health or rehabilitation.

If you have neurological injuries, fractures or other "higher trauma level" type injuries, then these services make more sense.

At this stage, you should contact your attorney.

In the hundreds of automobile cases, THE LAW OFFICES OF ALLAN S. FIELD has handled through the years; I can say the SOONER AFTER AN ACCIDENT I HAVE BEEN CONTACTED BY THE INJURED PARTY, THE BETTER I CAN MAXIMIZE THEIR ULTIMATE SETTLEMENT.

Our offices will select the appropriate medical professional in consideration of the area you live or work (for convenience of treatment) and for the nature and severity of your injuries.

It is imperative, even at the initial emergency room level that you are clear and specific with the attending physicians as to the fact that you were in an accident which caused these injuries and exactly what hurts due to the trauma.

Clear and concise medical records help increase all case value at time of settlement.

One of the main factors in our election of the right doctor for your continuing treatment is to ensure that the records and reports of the medical specialists are designed to maximize the presentation of your claim at the conclusion of treatment.

Next time, we will discuss how the insurance company places a value on your claim.

Friday, September 11, 2009

The sad reality is, if you drive or ride a motor vehicle on a frequest basis, you will experience an automobile accident at some point in your life.

The LAW OFFICES of ALLAN S. FIELD have over 25 years of experience in handling automobile accidents and typically settle dozens of claims every year.

For the rest of you "normal people" such an event will be an unique and unwanted experience.

Because of this fact, many accident victims make critical mistakes immediately following an accident which serves to do irreparable harm to the case.

Most important, a victim should never have a "chatty" conversation with the driver of the other vehicle at the scene of the accident (or subsequently for that matter).

If there is a police officer on the scene who is gathering information for a report (which happens less frequently these days) then by all means disclose what you recall to his / her inquiries.

I cannot tell how many victims I have represented who didn't even think an attorney was neccesary because the other party was "so nice" or "admitted fault" or "just wanted to keeps things simple" only to find to their surpirse that, all of a sudden, the other party did a "180" in their version of what happened and the "friendly insurance adjuster" was not really their friend after all.

But once these mistakes are made by the accident victim it is often too late to "put the horse back in the barn".
